WHAT I WON'T DRAW

I don’t accept NFT commissions nor allow NFTs as part of the copyright/usage policy, if you’re here for that, then this artist is not for you (Applies to both PERSONAL and COMMERCIAL USE).No, you are also not allowed to use the illustration for training AI-related use and then claim it as your own

The following price list and terms of service that are displayed are for PERSONAL-USE only. Please message me for further details on commercial projects.

By commissioning the artist (Minttydrops), you are agreeing to the terms of service. Please read the terms carefully.

🌻I. GENERAL TERMS

• First come first serve basis.
• The artwork will have a subtle watermark that you are not allowed to remove.
‣ Except for the visual novel package, it is required to credit the artist as "Minttydrops" (linking back is not required but always appreciated).
• The prices are subject to change based on demand.
• If Any issues arise on my part; I will contact you immediately.
• I have the right to accept or refuse commission requests without further explanations. (It might be uncomfortable to me).
• The artist reserves the right to stop work on a Commission or cancel a Commission request due to the client’s display of ill behavior or breach of these Terms of Service.

🌻II. PAYMENT

• I only accept payment through Paypal invoice only in USD, if you’re in the same country(PH) as mine, we can also settle in GCash
• I do not start on commissions until the FULL price is paid upfront unless the commission work is worth 90 USD or over.
‣ For the commissions that cost 90 USD or higher, I will require at least half payment to be made before I start the commission. The final artwork can only be sent when the other half of the payment has been made.
• If you don't pay on the agreed payments or left your commission for 4 weeks, I have the right to use the art for my own purposes.
• Don't send me any payment before I have agreed to give you a slot. I will send you an invoice which will indicate the time you will need to pay.

🌻III. COMMISSION STAGE, PROCESS & DELIVERY

• I will notify you when I have started on your commission and you, therefore, lose the rights to a refund (see VII. REFUND / CANCELLATION POLICY further below for more info about refunds)
• I'll send you art progress in low-quality images and watermarked versions.
Sketch > Lineart > Base Coloring > Final
• The time it takes to finish your commission can vary from 3 days – 4 weeks depending on the package and complexity of the commissioned artwork and revisions.
• Don't rush the artist, I don't accept rush commissions at the moment. If anything comes up due to health issues or other emergencies (which rarely happens), that will slow the progress of the estimated delivery time, I will let you know asap.
• Additionally, I will try to give you an estimate of the remaining time it will take to finish it.
• Once the piece is finished you will receive the full-resolution image. Note that this is a digital artwork hence there is no physical product that will be sent to you.

🌻IV. REVISIONS

• Maximum of 2 revisions, more than that, I will charge a revision fee. Revisions can only be done in the sketching stage. Very minor revisions like color changes for base colors are okay. Unless the mistake is my fault, the revision limit is not counted.
• PLEASE be specific with what your artwork will be. Each revision after that will cost you extra.
• If you wish for me to change/add something in the drawing you have previously approved, I will charge you an extra fee to change it. The amount of the extra charge depends on the change you want me to make and is usually based on an hourly wage.

🌻V. COPYRIGHT / USAGE POLICY

• I, Minttydrops (the artist), claim the rights to the produced drawing, not the client. Therefore, I am allowed to use the copyrighted artwork to:
‣ Promote myself with it anywhere
‣ Display it everywhere to my liking (website, social media, etc.)
‣ Post it wherever I want• The buyer is allowed to:
‣ Use the commissioned piece for personal use (you can upload it to all your social media profiles, forums, etc.)
‣ Print the artwork and claim the character(s) as their own, but not the artwork itself.
‣ Use the artwork as a gift.
‣ Use the artwork to promote themselves with proper credit to the artist.
‣ Use the artwork on their YouTube channel and in monetized videos as long as the artwork itself is not the main subject of the earnings• The following is considered copyright infringement:
‣ Reproducing/using the copyrighted artwork commercially – You may not profit from the art, sell prints or products, sell/mint the artwork for NFT
‣ Claiming the artwork as your own
‣ Removing my signature/watermark from the artwork
‣ Altering the artwork without my consent
‣ Edit/trace the artwork then claim that you have drawn the artwork.
‣ Use the artwork to train AI

🌻VI. CUSTOMER SATISFACTION

• If you have a problem with anything regarding the commissioned artwork, please tell me right away so we can find a solution together.
• I am willing to adjust some of my terms for you if you ask before I start on your commission. For example, we can discuss this if you do not want me to post the art anywhere.
• Giving clear visual references and a good description is highly encouraged. The more info the better. This will help us both to help you in what the final look of the artwork you aimed for.

🌻VII. REFUND / CANCELLATION POLICY

• Once I started the commission, strictly no refund under any circumstances.
• If for any reason I am unable to start your commission you will receive a full refund.
• If you cancel your order before I start it, you can get a full refund. When getting a refund, do not request a PayPal charge-back. I will transfer the money back to you myself.
‣ If you request a PayPal charge-back at any point when you were not allowed to ask for a refund you will lose all before-mentioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply PayPal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted from commissioning me in the future.🌻 If the client breaks any of the points stated above they will lose all the before-mentioned rights to the artwork commissioned by the artist, and I will have the right to profit further from the commissioned artwork and will have the right to use the art for my own purposes.Artworks that are for commercial use are not yet available.

🌻VIII. WHAT DO YOU GET?

• Sketch and/or final sketches that you approved before I continue the work
• Full resolution of final drawing in PNG with 300 dpi. If you wish, I can also send you a JPG file or a smaller image file for web uploads (you must specifically request this)

COMMERCIAL USE COMMISSIONS

‣ You intend to reproduce this artwork and make money off of it.
‣ e.g. Putting my artwork(s) on t-shirts, mugs, turning it into a sticker, and other items you will mass produce
‣ Making the artwork part of your brand
• During the sketch approval and work-in-progress stage, the artwork will have subtle watermarks that you’re not allowed to remove. This does NOT apply to the final copy. The final output will not have a watermark.
• It is important that you tell me what you're planning to do with the illustration.
• When asked, the client must properly identify the artist as the creator of the artwork. The client is still not allowed to claim the artwork that they have drawn them.
• Crediting and linking back to the artist is not required but it’s always appreciated
• Please know that requesting a commercial commission costs more.
• Any issues arise on my part; I will contact you immediately.

• After the full payment has been made and the client receives the final files of the artwork, the buyer now claims the license and rights to the produced drawing. Therefore, you are allowed to use the copyrighted artwork to:
‣ Promote yourself with it anywhere
‣ Publish books with it (artbooks, etc.)
‣ Display it everywhere to your liking (website, social media, etc.)
‣ Post it wherever you want
‣ Make a profit using this product and promote yourself. Crediting me as the artist is very appreciated as it helps me gain exposure!
• As the artist of the commissioned work, I, Minttydrops, have the right to post the artwork and use the artwork as a portfolio piece.
‣ The artist will not sell the works that the client had commissioned.🌻VI. CUSTOMER SATISFACTION
